Agreement and eligibility
These terms govern access to the ME & YOU website and administrative platform. You must be at least 18 years old to use the service. By accessing the site, creating an account, submitting an intake, or purchasing a program, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the service. You must be 18 or older, physically located in a state where clinical services are available at the time of care, and able to enter a binding contract. You agree that the information you provide is accurate and complete, that you will keep it current, and that you will not submit an intake on behalf of another person. We may update these terms; the effective date above changes and material changes are notified on the site or by email, and continued use after that date is acceptance. We may refuse, suspend, or terminate service at our discretion, including where information appears inaccurate or use appears unsafe or unlawful.
Platform and clinical services
ME & YOU provides technology and administrative support. It is not a medical practice and does not make clinical decisions. ME & YOU Health LLC provides a technology and administrative services platform. It does not practice medicine, does not employ or control clinicians in their clinical judgment, and does not decide whether treatment is appropriate. Clinical services are provided by an independent professional medical entity (Umsha Health LLC; medical director Joseph Palumbo, D.O.) and its licensed clinicians, who are solely responsible for clinical decisions and for the provider-patient relationship. Prescription fulfillment is handled electronically through the platform’s e-prescribing and fulfillment partner and dispensing is performed by licensed pharmacies, which are independent of ME & YOU. Fees paid to ME & YOU are for administrative, technology, and support services; clinical and pharmacy fees are charged for those services and are not a payment for any guaranteed outcome or prescription. No treatment, eligibility, or result is guaranteed. Nothing on this site is medical advice.
Prohibited use and intellectual property
You may not: misuse or attempt to gain unauthorized access to the site or any account; scrape, crawl, reverse engineer, or copy the site or its underlying code; upload malware or interfere with site operation; impersonate another person or provide false health or identity information; resell, redistribute, or transfer any medication or service obtained through the platform; or use the service for any unlawful purpose or in violation of the rules of a sport, league, or governing body. All content, copy, design, logos, trademarks, and software on this site are owned by ME & YOU Health LLC or its licensors and are protected by intellectual property law; you receive a limited, revocable, non-transferable licence to view the site for personal, non-commercial use only. Feedback you send us may be used without obligation. We may suspend or terminate access immediately for a breach of this section, and the sections that by nature survive termination — intellectual property, disclaimers, limitation of liability, disputes — continue to apply.
Disputes and governing law
The service is provided “as is” and “as available.” To the maximum extent permitted by law, ME & YOU disclaims all implied warranties, and is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data; our total aggregate liability for any claim is limited to the amount you paid ME & YOU in the 6 months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law, and nothing limits any claim against the medical entity or a clinician for clinical care. These terms are governed by the laws of the State of Wyoming without regard to conflict-of-law rules. You and ME & YOU agree first to try to resolve any dispute informally by writing to support@meandyouhealth.com and allowing 30 days. If that fails, any dispute is resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Sheridan County, Wyoming or conducted remotely, with each party bearing its own fees except as the rules provide. Claims are brought individually; class, collective, and representative actions are waived. Either party may bring a qualifying claim in small-claims court instead. You may opt out of arbitration by emailing support@meandyouhealth.com within 30 days of first accepting these terms. Any claim must be filed within one year of when it arose.
